These terms govern your use of the Zywo mobile app. By installing or using the app, you agree to them. If you do not agree, do not use the app.
1. Who can use Zywo
You must be at least 13 years old. If you are under the age of majority where you live, you need a parent or guardian's permission. You must have the legal capacity to enter this agreement.
2. Your account
You may play anonymously or sign in with Apple or Google. You are responsible for activity on your account. An anonymous account is tied to your device and may be permanently lost if you lose that device — link a sign-in method if your progress matters to you.
One person, one account. Do not share, sell or transfer accounts.
3. Health and safety — read this one. Zywo encourages physical exercise. It is a game, not a medical device, a coach, or a source of medical advice.
Consult a doctor before starting any exercise programme, especially if you have a medical condition, an injury, or have been inactive. Stop immediately if you feel pain, dizziness or shortness of breath. You exercise at your own risk.
Never let the game push you past your limits. Never use the app while driving, cycling in traffic, or anywhere that demands your attention. Make sure you have clear space around you before starting a camera workout. Step counts, calorie figures and rep counts are estimates and are not accurate enough to rely on for any health purpose.
To the fullest extent permitted by law, we are not liable for any injury or health consequence arising from exercise you undertake while using the app.
4. Fair play
Progression in Zywo is meant to come from real physical activity. You must not:
- falsify activity data, whether by device shakers, modified fitness apps, injected health records, or any other method;
- play videos or use another person's movement in front of the camera to earn reps;
- modify, reverse engineer or tamper with the app or its network traffic;
- use bots, automation or multiple accounts to gain an advantage;
- exploit bugs instead of reporting them;
- harass other players or use an offensive display name.
We use automated anti-cheat checks. If we detect manipulation, we may reset progress, remove rankings, restrict matchmaking or terminate the account. Serious or repeated cases result in a permanent ban with no refund.
5. Purchases and subscriptions
- Paid features unlock content and options. They do not make your creature statistically stronger than a free player's, and paid and free players compete in separate ranked leagues.
- All purchases are processed by Apple or Google under their terms. We never see your payment details.
- Subscriptions renew automatically until you cancel. Cancel through your App Store or Google Play account settings — deleting the app does not cancel a subscription.
- Refunds are handled by Apple and Google under their policies. We cannot issue refunds directly.
- Virtual items, currency, creatures and progress have no monetary value, cannot be exchanged for money, and are licensed to you rather than owned by you.
6. Advertising
The app may offer optional rewarded video ads. Watching one is always your choice and nothing in the game requires it. Rewards are granted only after an ad is verified as fully watched.
7. The game will change
Zywo is a live game. We regularly adjust balance — experience rates, damage values, spell costs, matchmaking — to keep it fair and interesting. Features may be added, changed or removed. Balance changes are not a defect and do not entitle you to a refund.
We aim for the service to be available continuously but do not guarantee uninterrupted access. Maintenance, outages and third-party failures happen.
8. Intellectual property
The app, its artwork, creatures, characters, code and branding are owned by Marko Andrijević & Marko Raković and protected by copyright and trade mark law. You get a personal, non-exclusive, non-transferable, revocable licence to use the app for private, non-commercial purposes. You may not copy, distribute, or create derivative works from it.
Content you create — your display name, for example — remains yours, but you grant us a licence to display it inside the game to other players.
9. Termination
You may stop using the app and delete your account at any time from Profile → Settings. We may suspend or terminate your account if you breach these terms, if required by law, or if we discontinue the service. If we discontinue the service entirely, we will give reasonable notice.
10. Disclaimers and liability
The app is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not warrant that it will be error-free, that activity tracking will be accurate, or that data will never be lost.
To the fullest extent permitted by law, our total liability arising out of or relating to the app is limited to the greater of the amount you paid us in the twelve months before the claim, or EUR 50. We are not liable for indirect, incidental or consequential damages, loss of progress, or loss of data.
Nothing in these terms limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or fraud. If you are a consumer, you keep all mandatory statutory rights under the law of your country of residence.
11. Third parties
The app relies on services from Apple, Google, Supabase, RevenueCat and others. Their terms apply to their parts of the experience, and we are not responsible for their actions or outages. Zywo is not sponsored, endorsed or administered by Apple or Google.
12. Changes to these terms
We may update these terms. The effective date above reflects the current version, and we will notify you in the app before a material change takes effect. Continuing to use the app after that means you accept the new terms.
13. Governing law
These terms are governed by the laws of the Republic of Serbia, without regard to conflict of law rules. If you are a consumer resident in the EEA or UK, you may also rely on the mandatory consumer protections of your country of residence, and may bring proceedings there.
